On 26 August 2024* the new right to disconnect laws took effect under the Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024.  Employees of non-small business employers have the right to refuse to monitor, read or respond to contact (or attempted contact) outside their working hours, unless doing so is unreasonable. This includes contact (or attempted contact) from an employer or a third party.  Third parties can include clients, suppliers, staff from other businesses, or members of the public. Contact can include a range of communication channels used to engage with employees, such as calls, emails, texts, social media and messaging services. 

The Right to Disconnect Email Comms (For Managers) can be sent via email (or your preferred communication forum) and provides your people managers and management team with an overview of the right to disconnect law, introduces your Right to Disconnect Policy, highlights how it impacts decision making moving forward  + provides practical tips of how to communicate with their team outside of working hours. 

Note: Small business employers' (less than 15 employees) have until 26 August 2025 to comply with the new law, although small business owners may wish to be on the front foot as staff will likely be asking questions about the 'right to disconnect'.
