Right to Disconnect Policy
On 26 August 2024* the new right to disconnect laws took effect under the Fair Work Legislation Amendment (Closing Loopholes No. 2) Act 2024. Employees of non-small business employers have the right to refuse to monitor, read or respond to contact (or attempted contact) outside their working hours, unless doing so is unreasonable. This includes contact (or attempted contact) from an employer or a third party. Third parties can include clients, suppliers, staff from other businesses, or members of the public. Contact can include a range of communication channels used to engage with employees, such as calls, emails, texts, social media and messaging services.
This Right to Disconnect Policy outlines (a) the principles governing the right to disconnect under the new law, (b) the procedures to support the practical implementation of this right internally within your business, and (c) the process to handle any instances of non-compliance by staff.
The Policy endeavours to ensure that all employees are treated (and others are treated) in a way that balances productivity in the workplace plus clarifying when contacting employees outside of working hours may be reasonable, while being conscious of everyone’s health and wellbeing and being respectful of everyone's time and personal commitments.
Note: Small business employers' (less than 15 employees) have until 26 August 2025 to comply with the new law, although small business owners may wish to be on the front foot as staff will likely be asking questions about the 'right to disconnect'.
This Policy is general in nature, for award/agreement free employees. If you require this Policy tailored for a specific award/agreement, contact the Team at hello@workchapters.co.
